Russia is not legally bound to UN and this may be reason for its impudence – diplomat Yelchenko

Diplomat, former Permanent Representative of Ukraine to the UN Volodymyr Yelchenko told this live on air of Espreso TV channel.

"I would not talk about the exclusion of the Russian Federation from the UN, but about deprivation of powers in the UN and in all the organizations of the UN system. In December 1991, Russia did not go through the established and recorded in the UN charter admission procedure. They only changed the sign with the name of the country. Question was not considered, discussed, or voted on," he said.

According to Yelchenko, neither the Security Council nor General Assembly made any decisions about Russia's accession to the UN. 

"Secondly, why has the State Duma (Russian Parliament) of the Russian Federation not yet ratified the UN charter? Ukraine reconfirmed ratification in 1991. Even this was not done, they simply changed the sign there based on Yeltsin's letter and a very dubious declaration of CIS summit, which not all countries signed. The decision about accession had to be approved on the basis of recommendations of the UN Security Council, which would then be approved by the General Assembly. As it was at least a dozen and a half times in the history of the organization. The last time was Czech Republic and Slovakia after separation and all 6 former republics of Yugoslavia," the diplomat said.

He emphasized that Russia is the only case in the history of the UN when a country was never accepted, but is a member of the organization.

"Perhaps, Russia behaves so defiantly in the world, because it is in no way legally bound by norms or principles of the UN Charter, because it has never ratified it," Yelchenko concluded.

  • Ukraine submitted an official request to exclude Russia from the UN Security Council and organization itself.
