Polish police opposes Ukraine’s participation in missile crash investigation
The Polish Prosecutor's Office will not agree to involve the Ukrainian side in the investigation of the missile explosion in the village of Przewodów, which killed two men
Polish outlet Rzeczpospolita reported on the information.
"There is no such legal possibility, and it would be contrary to the procedure, not to mention the interests of the investigation, in the framework of which all possible versions are being considered, including the fact that an anti-aircraft missile could have fallen from Ukraine," say sources of the outlet familiar with the case.
The publication notes that the behavior of politicians who misled the public, claiming that not only Ukrainians, but also Americans are already involved in the investigation, is surprising. Nothing like that is taking place.
The news that the Ukrainian experts arrived in Przewodów on Friday afternoon was reported by mass media. In the evening, the Minister of Foreign Affairs of Ukraine, Dmytro Kuleba, published a corresponding post on Twitter.
“Ukrainian experts are already working at the site of the tragedy in Przewodów caused by Russian missile terror against Ukraine. I am grateful to the Polish side for granting them access. We will continue our cooperation in an open and constructive manner, as closest friends do,” he wrote.
Ukrainian investigators arrived in the village of Przewodów after the end of the inspection conducted by Polish investigators and were able to see the scene of the incident - the remains of the missile and the funnel, but no procedural actions were taken, since this is impossible under the law (just as Polish investigators cannot carry out evidentiary actions on the territory of a foreign state, at most they can be a "passive observer").
There are more severe inaccuracies. Jakub Kumoch, head of the international department of the Office of the President of Poland, said in an interview with TVN 24 on Thursday that a Polish-American investigative team is working in Przewodów, and that Ukrainians have also requested access to the investigation.
"If both sides agree, and as far as I know, there will be no objections from the American side, then such access can be granted in the near future. If the investigative team has no objections at the technical level, then there will probably be no reason to deny Ukrainians access," he said.
However, there were no American experts on site - their role is to provide access to classified materials from the AWACS system.
Decisions on the course of the investigation and its directions are made exclusively by the Polish Prosecutor's Office. Even the head of the National Security Bureau, Jacek Sievera, admitted that although the participation of Ukrainian observers is possible, it does not mean that they will participate in the investigation, explaining that "this requires compliance with justice and related procedures."
The participation of Ukrainians in the investigation would be possible within the framework of the international investigative commission - but it has not yet been created.
"Polish citizens died. The investigation is being conducted by the Polish Prosecutor's Office and the Polish services cooperating with it. Negotiations are currently underway to develop the principles of cooperation, including issues such as the transfer of materials or the exchange of testimony," sources close to the investigation reported.
It is run by the Mazovia Directorate for Combating Organized Crime and Corruption of the National Prosecutor's Office.
